2. Data We Collect. When you submit a contact form or engage our services, we collect your name, email address, phone number, company name, and any information you provide in your message. We do not collect payment card data directly—payment processing is handled by Stripe under their own privacy policy.

3. Purpose of Processing. Your data is processed solely for the purpose of responding to your inquiry, delivering contracted services, sending invoices, and complying with legal obligations under French and EU law.

4. Legal Basis. Processing is based on Article 6(1)(b) of the GDPR (performance of a contract or pre-contractual measures) and Article 6(1)(f) (legitimate interest in responding to business inquiries).

5. Data Retention. Contact form submissions are retained for 24 months from the date of submission. Contract-related data is retained for the duration of the contract plus 5 years in accordance with French commercial law. Invoices are retained for 10 years per Article 102 of the French General Tax Code.

6. Data Sharing. We do not sell, rent, or share your personal data with third parties except: (a) Stripe, for payment processing; (b) hosting providers within the EU for infrastructure; (c) when required by law or court order.

7. International Transfers. All data is stored within the European Economic Area. Should any transfer outside the EEA become necessary, we will ensure adequate safeguards under Article 46 of the GDPR are in place.

8. Your Rights. Under the GDPR, you have the right to access, rectify, erase, restrict processing, object to processing, and port your data. You may exercise these rights by contacting [email protected]. You also have the right to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés).

9. Security. We implement appropriate technical and organizational measures including encrypted storage, access controls, and regular security reviews to protect your personal data against unauthorized access, alteration, disclosure, or destruction.

Terms of Service

1. Scope. These terms govern all services provided by WebLogicxForge, including web platform development, API gateway configuration, infrastructure setup, and ongoing maintenance retainers.

2. Agreements. Each project begins with a written Statement of Work (SOW) specifying scope, deliverables, timeline, and pricing. These terms apply in addition to any specific SOW.

3. Intellectual Property. Upon full payment, all intellectual property rights in deliverables—including source code, configurations, documentation, and design assets—are transferred to the client. WebLogicxForge retains the right to use general knowledge, techniques, and non-client-specific tools developed during the engagement.

4. Payment Terms. Invoices are due within 14 days of issuance unless otherwise specified in the SOW. Late payments incur a statutory interest rate of three times the French legal interest rate, plus a fixed recovery fee of €40 per Article L.441-10 of the French Commercial Code.

5. Project Changes. Changes to the agreed scope require a written change order. WebLogicxForge reserves the right to adjust timelines and pricing for out-of-scope requests.

6. Limitation of Liability. WebLogicxForge's total liability shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.

7. Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination by 2 years.

8. Termination. Either party may terminate a project with 14 days' written notice. Upon termination, the client pays for all work completed to date. Pre-paid fees for uncompleted work are refunded within 30 days.

9. Governing Law. These terms are governed by French law. Disputes shall be submitted to the competent courts of Paris, France.

Refund Policy

1. Project-Based Work. For fixed-price projects defined in a Statement of Work, refunds are available for work not yet delivered. Completed and accepted deliverables are non-refundable. If a project is cancelled before completion, the client is invoiced for all work completed to date, and any excess payment is refunded within 30 days.

2. Maintenance Retainers. Monthly retainer services may be cancelled with 30 days' written notice. No refund is issued for the current billing period. Annual retainer commitments may be refunded on a pro-rata basis for unused months, minus a 10% administrative fee.

3. Defective Deliverables. If deliverables do not conform to the specifications in the SOW, WebLogicxForge will, at its discretion, remediate the defect at no additional cost or provide a proportional refund. Bug reports must be submitted within 30 days of delivery.

4. Refund Process. Refund requests must be submitted in writing to [email protected]. Approved refunds are processed within 14 business days to the original payment method via Stripe.

5. Non-Refundable Items. Third-party costs incurred on behalf of the client (domain registrations, hosting fees, API subscriptions, stock assets) are non-refundable once incurred. Consultation fees for scope analysis are non-refundable.
